JC man convicted of DWI, resisting arrest

A Cole County jury found a Jefferson City man guilty of driving while intoxicated and resisting arrest charges in connection with an incident that occurred in February 2014.

The prosecutor's office said it took the jury only about two hours before finding Wayne Kurtz Jr., 37, guilty.

Kurtz was involved in an accident on U.S. 50 where his vehicle slid off the road and crashed into a bluff.

A passerby notified authorities of the crash and when Cole County Sheriff's Department deputies got there, they found Kurtz still behind the wheel and on his cell phone arranging for a tow.

Noticing he appeared to be drunk, deputies had Kurtz start to perform standard field sobriety tests, but after completing just one of those he became belligerent and refused to perform any more.

When told he was being arrested, Kurtz got into a struggle with a deputy, but was eventually taken to the ground and placed in custody.

A breath sample was obtained, and Kurtz's blood alcohol content was found to be .125.

Prior to the trial, the court ruled Kurtz was a persistent DWI offender and a prior and persistent felony offender. That means during sentencing the range of punishment on one count will be up to seven years in prison which could be concurrent on the two counts or consecutive.

A sentencing hearing before Judge Jon Beetem is scheduled for July 28.
